By using the We Got Talent Service, you (a User) agree to these Terms of Service. Please read the following Terms of Service carefully before using the We Got Talent Service. If you do not agree with the Terms of Service, please do not use the We Got Talent Service. These Terms of Service apply to any use of the We Got Talent Service.

A more detailed description of the We Got Talent Service is available at
www.finnishgameday.com, www.gamesfactorytalents.com, www.gamesjobfair.com, www.gamedevtalents.com, www.talents.games and other websites and subdomains operated by We Got Talent Oy, including pages describing the Careers Zone platform.

If you register as a company, association or any other legal entity, you represent and warrant that you are authorized to bind that entity into these Terms of Service.

"Partner"
means a company or other partner that uses the We Got Talent Service for recruitment or related activities (for example, game studios, technology companies, event organisers such as Steel Media Ltd / Pocket Gamer Connects), whether or not there is a separate written service agreement in place.

"We Got Talent" means We Got Talent Oy, company ID 2924802-6.

“Technical Provider”
means Intelligent Solutions Finland Oy or another subcontractor that develops, hosts or technically operates parts of the We Got Talent Service (including the Careers Zone platform) on behalf of We Got Talent.

"We Got Talent Platform"
means the online platforms and tools operated under the company name We Got Talent Oy, including but not limited to Careers Zone, Games Job Fair platforms and the GameDev Talent Board.

"We Got Talent Website”
means the websites www.gamesfactorytalents.com, www.gamesjobfair.com, www.gamedevtalents.com, www.talents.games, and any other domains or subdomains operated by We Got Talent.

“We Got Talent Service”
means both the We Got Talent Platform and the We Got Talent Website and any related services, including the Careers Zone matchmaking platform and recruitment activities at events.

“Recruiter”
means a User that is a company, studio, publisher or other organisation (or their representative) using the We Got Talent Service to promote roles, search for Candidates and/or otherwise engage in recruitment.

“Recruitment Event”
means any event, fair, conference or online programme organised or co-organised by We Got Talent or Partners, where the We Got Talent Service (including Careers Zone) is used to connect Candidates and Recruiters. This includes, for example, events run in cooperation with Steel Media Ltd under the Pocket Gamer Connects  brand.

“Careers Zone”
means the matchmaking and recruitment-support area and digital platform operated by We Got Talent, which may be used online and/or at Recruitment Events to connect Candidates and Recruiters and to facilitate meetings, interviews and job discussions.

3.1. We Got Talent also organizes recruitment events for European and UK game companies (hereinafter referred to as the "Recruitment Event").

3.2. The We Got Talent Platform is a way for Partners and Users to connect. Users use the We Got Talent Platform to send in their personal data and resume, for the Partners to review, with the intent of recruiting.

3.3 The Careers Zone is part of the We Got Talent Service. It is a matchmaking platform and onsite or virtual recruitment area that:

• allows Candidates to create profiles, upload CVs and indicate their preferences;
• allows Recruiters to post roles, describe their company and search for suitable Candidates;
• may use algorithmic and AI-based matching to recommend Candidates to Recruiters and roles to Candidates;
• enables direct communication and/or meeting scheduling between Candidates and Recruiters, especially around Recruitment Events.

3.4. We Got Talent is not a party to any employment or contractor relationship that may arise between Candidates and Recruiters. Any employment contracts, freelance agreements or other arrangements are concluded directly between the relevant Candidate and Recruiter. We Got Talent does not guarantee that a Candidate will be hired or that a Recruiter will find a suitable candidate.

3.5. The use of the We Got Talent Service may require you to accept terms and conditions of third-party services (for example event platforms, ticketing systems, communication tools or other services provided by event organisers or Partners). We Got Talent is not responsible for such third-party services.

4.1. In order to use the We Got Talent Service, the User may need to create a user account by following the registration instructions in the We Got Talent Service. The We Got Talent Service credentials are personal (or, in the case of a company account, limited to the authorised representatives). The User shall ensure that any user account credentials and equivalent information required to access the user account of the User are kept confidential and used in a secure manner not accessible by third parties.

4.2. Where it is suspected that any unauthorised person has become aware of a User’s user account credentials or has access to the user account of the User, the User shall immediately inform We Got Talent thereof. The User shall be responsible for any use of the We Got Talent Service and any activity under the user account of the User.

4.3. We Got Talent is entitled to suspend or close a User’s account and/or access to the We Got Talent Service with immediate effect if We Got Talent reasonably suspects that the User is abusing the We Got Talent Service, violating these Terms of Service or applicable law, or causing harm or risk to other Users, Partners or We Got Talent.

5.1. All Intellectual Property Rights in or related to the We Got Talent Service and thereto related documentation and all parts and copies thereof shall remain exclusively vested with and be the sole and exclusive property of We Got Talent and/or its subcontractors/licensors (including the Technical Provider).
“Intellectual Property Rights” shall mean copyrights and related rights (including database and catalogue rights and photography rights), patents, utility models, design rights, trademarks, trade names, trade secrets, know-how and any other form of registered or unregistered intellectual property rights.

5.2. These Terms of Service do not grant you any Intellectual Property Rights in the We Got Talent Service and all rights not expressly granted hereunder are reserved by We Got Talent and its subcontractors/licensors.

5.3. You retain any Intellectual Property Rights to the content you submit to the We Got Talent Service (such as CVs, job descriptions, company logos and descriptions). By submitting such content, you grant We Got Talent a non-exclusive, worldwide, royalty-free licence to use, reproduce and display such content as necessary for operating the We Got Talent Service, including to present your information to relevant Users and Partners in connection with recruitment.

6.1. The User shall observe all applicable rules and regulations when using the We Got Talent Service.

6.2. We are constantly developing the We Got Talent Service and we may change or remove different parts of the We Got Talent Service, including features available in the We Got Talent Service in part or in whole.

6.3. By using the We Got Talent Service, the User may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. We Got Talent generally does not review content provided by the Partners. We Got Talent is not responsible for third parties' (including the Partners') content or information or for any damages arising as a result of the use of or reliance on it.

6.4. You shall be responsible for obtaining and maintaining any devices or equipment (such as telephones) and connections needed for access to and use of the We Got Talent Service and all charges related thereto.

6.5. The User will not: (i) use or attempt to use another person's We Got Talent account without consent of that other person; (ii) copy, modify or create derivative works of the We Got Talent Service or any related technology; (iii) reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the We Got Talent Services or any related technology, or any part thereof; (iv) remove any copyright, trademark or other proprietary rights notices contained in or on the We Got Talent Service; (v) remove, cover or obscure any advertisement included on the We Got Talent Service; (vi) collect, use, copy, or transfer any information obtained from the We Got Talent Service without the consent of We Got Talent; (vii) use bots or other automated methods to use the We Got Talent Service; (viii) create a We Got Talent account using a fake identity or an identity of another person; and (ix) access the We Got Talent Service except through the interfaces expressly provided by We Got Talent, such as the We Got Talent Platform and We Got Talent Website.

6.6. We Got Talent is entitled to remove a User from the We Got Talent Service with immediate effect and/or refuse if the User abuses the We Got Talent Service or causes any harm or detriment to the use of the We Got Talent Service or We Got Talent.

6.7. We Got Talent shall process any personal data collected from the User in accordance with the our Privacy Statement.

6.8. Additional provisions for Recruiters
Recruiters using the We Got Talent Service agree to:

• Use Candidate data obtained via the We Got Talent Service only for recruitment and closely related HR purposes;
• Provide accurate and lawful job descriptions and company information;
• Refrain from discriminatory, unlawful or unethical hiring practices;
• Comply with applicable data protection and privacy laws when handling Candidate personal data.

Recruiters acknowledge that they are independent controllers of Candidate data for their own recruitment processes and must provide their own privacy information where required by law.

6.9. Additional provisions for Candidates
Candidates using the We Got Talent Service agree to:

• Provide accurate, current and complete information in their profiles and applications;
• Refrain from uploading content that is unlawful, offensive or infringes the rights of others;
• Understand that We Got Talent does not guarantee any specific result or job offer and that all hiring decisions are made by Recruiters.

7.1. These Terms of Service are in force as a binding agreement until further notice as long as the User is using the We Got Talent Service.

7.2. The user can discontinue the use of the We Got Talent Service at any time. We Got Talent can discontinue providing the We Got Talent Service permanently or temporarily at any time.

8.1. The following section is only applicable to non-consumer Users of the We Got Talent Service: Under no circumstances shall We Got Talent be liable to the User for any indirect damages, including lost profits, lost sales or business, lost data or business interruption, or for any direct damages in excess of the amounts actually retained by We Got Talent from the User in the three (3) months preceding the event giving rise to the claim.

9.1. These Terms of Service shall be governed by and shall be construed in accordance with the laws of Finland. Any dispute, controversy or claim arising out of or relating to these Terms of Service, or the breach, termination or validity thereof that cannot be agreed upon by means of negotiation between the parties shall be finally settled by the District Court of Helsinki.

10.1. These We Got Talent Terms of Service may be updated from time to time, for example to reflect changes in our services, business or applicable law.

10.2. We will publish the updated Terms of Service on the We Got Talent Website and indicate the date of the latest revision. We recommend that you review the Terms regularly.

10.3. If we make changes that materially affect your rights or obligations, we will provide additional notice in a reasonable way, for example by email or by displaying a notice within the We Got Talent Service.

10.4. If you do not agree with the updated Terms of Service, you should discontinue using the We Got Talent Service. By continuing to use the We Got Talent Service after the updated Terms of Service have become effective, you are deemed to accept the changes.

11.1. We Got Talent shall be entitled to assign all or any of its rights or obligations hereunder in whole or part to an affiliate or successor or to a purchaser or acquirer of its business assets relating to We Got Talent Service without the User's prior consent.

11.2. The User shall not be entitled to assign any of its rights or obligations hereunder in whole or part.
